These Terms constitute a legal agreement between you (the “Customer” or “User”) and GENOPAWS Co., Ltd. (“GENOPAWS”, “we”, “our”) governing your access to and use of our website, membership account, pet genetic-testing services, and other pet testing services. Please read them carefully before using the service.
“GENOPAWS” is operated by GENOPAWS Co., Ltd., registered at 720 Mahachai Road, Wang Burapha Phirom, Phra Nakhon, Bangkok 10200, Thailand. For ease of reading, the following terms have the meanings given to them throughout these Terms.
“Service” or “Services” means GENOPAWS' products, hardware, software, membership system, website, pet genetic-testing services, and other laboratory testing services for pets (such as allergy testing) (including but not limited to images, text, graphics, and other material or information) that can be accessed from time to time by the user, whether or not in connection with an account, including the collection, processing, extraction, and analysis of a pet's Sample, Genetic Information, and other test results.
“Genetic Information” means the DNA data and the data derived from the analysis of your pet's Sample.
“Results” or “Content” means the analyses, reports, interpretations, and information GENOPAWS prepares or makes available to you.
“Sample” means the pet's biological specimen (e.g. a buccal swab used for DNA extraction, blood, serum, hair, or any other specimen appropriate to the selected service).
“Laboratory Partner” means the laboratory or testing provider GENOPAWS engages or collaborates with to analyse Samples.
“GENOPAWS Research” means studies or research GENOPAWS conducts on non-identifiable data, and only where consent has been given under the applicable consent document.
“Product Development” means activities to develop new products or services performed on Aggregated Data that cannot identify any individual, such as improving the Service, conducting data analysis, or offering new products/services.
“User Content” means all information received from users other than Genetic Information and system-generated data, such as text, pet photographs, feedback, or other materials generated by users and submitted through the Service.
“Aggregated Data” means data combined with that of other users such that no individual user can be identified.
In providing the Service, we may collect:
For clarity, the Genetic Information we hold belongs to the pet, while the only human personal data we hold is that of the pet's owner, which we process in accordance with our Privacy Policy.
Your use of any GENOPAWS Service is a legally binding contract between you and GENOPAWS as set out in these Terms of Service (“TOS”), which apply to any use of the Service, including but not limited to:
To use the Service you must agree to these TOS; if you do not, you may not use the Service. You may accept by (1) clicking to accept or agree where GENOPAWS makes that option available, (2) acknowledging or consenting under the consent document, and/or (3) actually using the Service, in which case you are deemed to accept these TOS from that point onward. In addition, particular parts of the Service may be subject to additional guidelines or rules that may be posted, revised, or changed from time to time, which are incorporated into these TOS, and GENOPAWS may offer other services governed by different terms.
We believe everyone should be able to access and benefit from their pet's genetics. That said, there are a few restrictions on who may use the Service. By using the Service or creating an account, you represent, warrant, and agree that:
If you accept these Terms on behalf of another person for whom you have legal authority, you represent that you have the right and authority to do so.
The Service includes access to the GENOPAWS website, pet genetic-testing services — namely the collection, processing, extraction, and analysis of your pet's Sample and Genetic Information — as well as any other laboratory testing services GENOPAWS may offer (such as allergy testing). Unless stated otherwise, all new or enhanced features are subject to these Terms. You acknowledge and agree that the Service is provided on an “AS-IS” basis and is based on the genetic knowledge and technology available at the time of purchase or viewing. Because scientific knowledge and technology continually progress, GENOPAWS continually innovates, and the Service may change from time to time without prior notice, including that GENOPAWS may stop providing some parts of the Service (temporarily or permanently) without prior notice. You may stop using the Service at any time without notifying us, except where you wish to close your account. GENOPAWS bears no responsibility for any use of the Service that is not authorised under these Terms or other applicable terms.
5.1 Nature of the service. GENOPAWS' genetic-testing service analyses genetic markers and variants that are scientifically known at the time of testing and compares them against reference databases. Results are therefore a statistical estimate provided for informational purposes and are not a medical diagnosis.
5.2 Inherent limitations. Owing to the nature of genetic science, results may deviate at two levels: (a) the measurement level, which is highly accurate but not infallible and may be affected by sample quality or contamination or rare laboratory error; and (b) the interpretation and prediction level — such as breed identification and disease-risk assessment — which is statistical inference by nature. Breed-identification accuracy depends on the coverage of the reference database, while the detection of a disease-associated gene indicates only risk or carrier status and does not confirm that a condition is or will be present, because gene expression (penetrance) is incomplete and is influenced by environmental and other genetic factors. Testing further covers only variants currently known to science, and interpretations may be updated as scientific knowledge advances.
5.3 Customer acknowledgement. The Customer acknowledges and accepts the above nature and limitations, and understands that results are for informational purposes only, should not be used as the sole basis for any health, breeding, or care decision, and should always be considered together with advice from an appropriately qualified professional.
5.4 Application to other testing services. The limitations and principles in this Section apply mutatis mutandis to GENOPAWS' other laboratory testing services (such as allergy testing). All results of every kind are informational only, are not a medical diagnosis, and should always be considered together with advice from a veterinarian or other relevant professional.
By using the GENOPAWS Service, you acknowledge, accept, and represent that:
You represent that you have the authority to make the above representations. In the event of any breach, GENOPAWS may suspend or terminate your account and refuse current or future use of the Service, and you agree to defend and indemnify GENOPAWS, its affiliates, and partners against any liability, cost, or damage arising from the breach.

To use the Service, you must first acknowledge and agree to our Privacy Policy, which explains how we collect, use, disclose, and protect your personal data under Thailand's Personal Data Protection Act B.E. 2562 (PDPA). You may not use the Service if you do not accept it, and you may signify acceptance by agreeing where GENOPAWS provides the option, or by actually using the Service.
GENOPAWS does not control User Content posted through the Service and does not guarantee the accuracy or quality of any non-GENOPAWS content. To the extent permitted by law, GENOPAWS is not responsible for any non-GENOPAWS content, including any errors in it or any loss or damage resulting from its use. GENOPAWS reserves the sole-discretion right to review, filter, modify, or refuse content available through the Service, and to remove content it reasonably suspects violates these Terms.
User Content — GENOPAWS does not claim ownership of the User Content you provide (including feedback and suggestions). You retain your rights in your content. However, by submitting, posting, or displaying content, you grant GENOPAWS and its affiliates a royalty-free right and licence to use, reproduce, adapt, publish, and otherwise use that content to provide the Service to you. You warrant that you have the rights to such content and are responsible for protecting those rights.
Sample & Genetic Information — once your pet's Sample is processed, it cannot be returned. Any Genetic Information derived from the Sample remains your information, subject to the rights we retain under these Terms. You understand that you should not expect any financial benefit from GENOPAWS as a result of having Genetic Information processed, or from its inclusion in non-identifiable Aggregated Data.
Waiver of property rights — you understand that providing a Sample, processing or accessing Genetic Information, or providing User Content gives you no rights in any research or commercial products that may be developed, and that you will receive no compensation.
Except as permitted in writing by GENOPAWS or its partner, you agree not to distribute, copy, sell, resell, publish, reproduce, duplicate, modify, or create for any commercial purpose all or any part of the Service.
GENOPAWS reserves the right, at any time and from time to time, to modify or discontinue the Service (in whole or in part), temporarily or permanently, with or without notice. You acknowledge and accept that (1) modifications may cause delays in processing some Services, and (2) GENOPAWS shall not be liable to you or any third party for any modification or discontinuance. GENOPAWS may also offer additional technologies or features in the future; your initial purchase does not entitle you to such additional technologies or features without fee, and you may have to pay additional charges to use them.
These Terms apply until terminated by you or by GENOPAWS. If you wish to terminate, you may do so by closing your account and notifying us. GENOPAWS may at any time terminate the agreement, your account, or your password if (1) you violate any provision or show you cannot comply; (2) required by law; (3) a partner with whom GENOPAWS offered the Service ends its relationship or stops serving you; (4) GENOPAWS no longer provides the Service in your country or region; or (5) provision of the Service is, in GENOPAWS' opinion, no longer commercially viable. Suspected fraudulent activity may be referred to appropriate law-enforcement authorities, and GENOPAWS has no liability to you or any third party for terminating your use of the Service.
Termination of these Terms or a user account will not affect any existing obligations to GENOPAWS, nor any rights or remedies that accrued before termination. Provisions that by their nature should survive (such as intellectual property, disclaimer of warranties, limitation of liability, and indemnity) will continue in effect.
The Service may contain links to third-party websites or resources, which GENOPAWS does not control and does not endorse. You acknowledge and accept that GENOPAWS will not be responsible, directly or indirectly, for any damage or loss caused by the use of or reliance on any content, goods, or services available on or through any such hyperlinked site or resource.
You acknowledge and agree that GENOPAWS (or its licensors) own all legal right, title, and interest in the Service, including any intellectual property rights (including but not limited to patents). The Service and any associated Software contain proprietary and confidential information protected by law. Except as expressly authorised, you agree not to (and not to permit others to) modify, rent, lease, loan, sell, distribute, create derivative works of, reverse-engineer, or attempt to extract the source code of the Service or Software. The GENOPAWS name, logos, and other marks are trademarks of GENOPAWS; nothing in these Terms gives you a right to use them, and you agree not to remove, obscure, or alter any proprietary notices in the Service. You agree to access the Service only through the interface GENOPAWS provides. Any rights not expressly granted are reserved.
YOU FULLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. GENOPAWS DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GENOPAWS MAKES NO WARRANTY THAT (a) THE SERVICE WILL MEET YOUR REQUIREMENTS; (b) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (c) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (d) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED, TO THE FULLEST EXTENT PERMITTED BY LAW.
You personally acknowledge and accept the risk of deviation described in Sections 5 and 6. WITHIN THE LIMITS ALLOWED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT GENOPAWS AND ITS LABORATORY PARTNER HAVE NO LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) RESULTING FROM: (1) inability to use the Service; (2) any action you take based on results or information received; (3) your failure to keep your login credentials confidential; (4) unauthorised access to or alteration of your data; (5) improper authorisation of the Service by someone claiming authority; or (6) statements or conduct of any third party on the Service. GENOPAWS' total aggregate liability, if any, shall not exceed the fee actually paid for the test giving rise to the claim.
GENOPAWS may notify you by email or post, and may give notice of changes to these Terms or other matters by displaying notices or links on its website or through the Service. Notices not complying with this Section shall have no legal effect.
GENOPAWS may change these Terms from time to time. When changes are made, we will post the updated version on the website. You understand and agree that if you use the Service after the date the Terms were changed, GENOPAWS will treat your use as acceptance of the updated Terms.
If you violate any of these Terms and/or GENOPAWS has reason to suspect that you have, GENOPAWS may suspend or terminate your account and refuse any current or future use of the Service.
Entire agreement — these Terms (together with the Privacy Policy) are the entire agreement between you and GENOPAWS governing your use of the Service. You may be subject to additional terms when you use partner services or third-party content/software.
Governing law & disputes — any dispute arising from this agreement shall be governed by the laws of the Kingdom of Thailand regardless of your origin or where you access the Service, and shall be subject to the jurisdiction of the Thai courts.
Admissibility of electronic records — a printed version of this agreement and any notice in electronic form shall be admissible as evidence to the same extent as business documents generated in printed form.
Section titles are for convenience only and have no legal effect. Severability — if any portion is unenforceable, the remainder remains in full force. Assignment — you may not assign your rights or obligations; GENOPAWS may assign all or part of its rights and obligations.
